TERMS & CONDITIONS OF NUKI SHOP

1. INTRODUCTION

The object of the Terms & Conditions is to regulate use and operation of an online store under the name 'nuke.pl' operates via www.nukishop.co ('Store'). 

Terms & Conditions are designed to define the rights and obligations of customers, as well as the rights, duties and responsibilities of the Administrator as the entity managing Store.

Please note that by using Store you agree to comply with the following Terms & Conditions.

The administrator of the Store is Boleo Spółka z Ograniczoną Odpowiedzialnością with its seat in Dąbrówka 62-070, Głogowa 8/1 street, registered under KRS no 493243, Tax Identification Number no NIP 7773235370 ('Administrator').

The customer shall mean the natural person who has at least a limited capacity to conduct legal acts under the polish civil law and 18 years of age, as well as a legal person or organization unit without legal personality, which has legal capacity to act ('Customer’).

2. ORDERS

Store sells its goods via Internet. Orders can be placed only on http://nukishop.co

At the moment of placing the Order by the Customer the contract of sale of the goods is concluded. After placing an order the customer receives a conformation by e-mail. Order processing begins within 24 hours of receipt of full payment.

The Store has the right to refuse to carry out order in case of:
a) the order form is filled incorrectly, or
b) the order has been placed ​​in violation of these Terms and Conditions

Customer may introduce changes to the order until the order processing has been started i.e. within 24 hours from the time of the order placing. Customer can cancel the order at any time before its performance has been started by sending an email to: contact@nukishop.co. 

Customers chooses the currency at the time of order placing. All prices include applicable taxes. The price does not include any due customs fee. The price is valid from the time of the order (and its confirmation by Store) and it can not be changed under any circumstances.

Store reserves the right to: change the prices of goods, introduce new products to the Store, carry out and cancel promotions at the Store or modify its conditions at any time.

Shipping costs are added to the order price at the rates indicated in the Shipping Information

3. PERFORMANCE AND CONTRACT

Delivery method shall be selected by the customer and specified in the order.

Payment shall be made before processing of order is started.

Order will be processed provided that ordered goods are available. In case of temporary lack of ordered goods, the order will be executed right after the good is made, but no later than 30 days since the day of order.

Store shall reserve the right to refuse an order in the event of an error on Store’s website.

In case of any circumstances preventing Store from fulfillment of the order, for reasons beyond Store’s control, Store reserves the right to suspend its execution. Store shall immediately notify customer. In such case customer will have right to cancel the order.

Obligations of the Customer arising from the contract of sale of goods remain in force until payment of the total amount due for Goods and cost of delivery of the Goods.

The Store shall be obliged to deliver ordered goods without any defects.

4. SHIPPING AND DELIVERY

Products are delivered to the address indicated by the Customer in the order form. Please fill in carefully your address to avoid delivering problems. Goods are delivered by DPD Poland Sp. z o. o..

Store ships in Europe using a fixed price, which depends on the weight, the volume and the destination. Shipping within EU is available with exclusive: Canary Islands, Ceuty, Mellila, Busingen (Germany), Montenegro, Kosovo, Highlands, Sky, Orkney, Sheltand, Oban, Arran, Vatican, San Marino, Livigno and Campione d’Italia. Shipping quotes are done on a per order basis and dependent on destination.

Shipping costs are in any case indicated to the Customer before order confirmation. Once payment has cleared, we will dispatch your order. Store products are made to order that is way delivery time is always specified in order data sheet. 

Delivery shall be deemed to have been made when the products are delivered to the carrier. The delivery note given by the carrier, dated and signed by the Customer upon delivery will constitute evidence with regard to transport and delivery. In the event of undelivered products due to Customer absence or wrong address, the products will be returned to Store which reserves its right to refund to the Customer the price of the products, the postage costs remaining payable by the Customer.

The cost of delivery within EU is 10-40 Euro with exclusive the countries mentioned above. The cost of delivery is always provided when making an order (choosing delivery method). The delivery costs are also shown during order placement.

Customer s obliged to accurately inspect the consignment for the damage and destruction caused in transport. If there were any, they should be immediately report to the courier and draw up a protocol damage. Failure to notify damage to transport and receive shipment makes it impossible to apply for reimbursement of the cost of repair or replacement product (insurance).

5. WITHDRAWAL FROM A SALES CONTRACT, PRODUCTS RETURNS

A Customer, who according to the relevant provisions is a consumer, has the right to withdraw from a sales contract without giving any reason as long as the Product was not customised to the consumer’s needs or was not prefabricated nor produced based on individual specifications meeting the Customer’s individual needs.

Free of charge, extended 2-year guarantee for all goods applies. In the event of a product fault that is covered under the terms of the warranty, we shall repair the products, supply a replacement or refund the purchase price at our discretion.

The withdrawal period, apart from the aforementioned point 2 exclusions, finishes 14 days after the Customer received the Products or a third person (other than a delivery company), authorised by the Customer, received the Products.

The Products excluded from the right of withdrawal from the distance contracts include all on which Store does individualised and personalised. The Products which are prepared owing to a Customer’s individual and personalised order are excluded from the right of withdrawal.

The Store offers high quality products. We take great care in making each piece. All pieces are inspected at the factory to make sure they are perfect before shipping to our customers. If a shipment arrives with the appearance of shipping damage or a manufacturing defect, please notify us immediately (within 24 hours) at contact@nukishop.co and we will do our best to resolve whatever issue there is as quickly as possible.

If the Customer is not satisfied with the product he/she can return it within fourteen (14) days of delivery receipt. The Client must inform The Store by e-mail to contact@nukishop.co about the return. Customer after consultation with NUKI can send the Order back on the given address:

NUKI SHOP reserves the right to refuse a returned product if the customer has not contacted us beforehand. 

The return or replacement costs of the goods after the withdrawal from the sales contract, are covered by the Customer. In the case of replacing the goods, the customer covers the twice value of the delivery costs.

Any goods returned must be returned in its original packaging, in the condition in which Costumer received them, shall neither have been used, nor have suffered any damage. The store is unable to accept returns or offer an exchange or a refund for items that are not returned in exactly the same condition that they were purchased.

In case of a withdrawal the Shop shall refund all the relevant to the withdrawal payments it has received, including delivery costs (excluding any extra costs arising from a particular delivery chosen by the Customer which are different from the cheapest normal delivery offered by Store) immediately or no later than within the 14 days from the day that the product(s) is returned to the Store. The store will not be held responsible for the refund or the compensation of Products that have been lost, stolen or damaged.

6. COMPLAINT POLICY

Products sell in the Store are made to individual Customer order.  Even though items are packaged properly, transit-related damage can occur. All NUKI SHOP shipments are insured against loss or damage. When an order arrives, the Customer must inspect it carefully. 

If the Customer notice any damage to the boxes notify the Store immediately (within 24 hours) at contact@nukishop.co for further instructions. 

Claims will require original packaging and following digital photos:

  1. A picture of the complete outside of the box, clearly showing the parcel label
  2. A picture of the opened box, clearly showing the content and the interior packing
  3. A picture of the complete size of the article
  4. A detailed picture (close-up) of the concrete damage of the article.

It is the NUKI SHOP responsibility to pay for the complaint shipping costs only if buyer provide the DPD complaint protocol.

The Store will do everything to assist the Customer with the claim. The Store proceed with the Customer refunds in accordance to Polish Civil Code regulation art. 556 and art. 561. To file a complaint simply follow these easy steps:

- the complaint may be filed by fulfilling the Form of Complaint available on the Store’s website.

- please print and sign the fulfilled form of complaint (if the printing of the form is not possible, please send us fulfilled form to contact@nukishop.co)

The complaint will be examined by the Store within 14 days from the date of receiving of the complaint. The Store’s decision regarding the Customer’s complaint will be notified to the Customer by email or phone.

The Customer is responsible for new damage (not being the basis for the complaint) arising during return transport, resulting from defective packaging of the goods. There is no refund for items not received due to incorrect address.

The Store informs the Customer that the complaint may be resolved using alternative dispute resolution methods (ADR), including the Customer’s request for mediation or an application for consideration of the case before the arbitral court (the application for the arbitral court can be downloaded from the website http://www.uokik.gov.pl/download.php?plik=6223 ). List of Permanent Consumer Arbitration Courts is available on the website: http://www.uokik.gov.pl/wazne_adresy.php#faq596. ADR procedures after the complaint procedure is free of charge.

7. PRIVACY POLICY

Personal data of customers may be collected by Store in accordance with the Act of August 29, 1997 on Personal Data Protection. Acceptance of Terms & Conditions means a voluntary consent to the processing customer’s personal data for marketing purposes only by Store.

Pursuant to the Act of August 29, 1997 on Personal Data Protection Store informs that all personal data are kept in the Administrator’ s registered data collection. The personal data are being collected and processed exclusively for the purpose of execution of orders, conducting promotional campaigns and marketing purposes due to data protection requirements specified in Security Policy of 'NUKI'.

8. COOKIES POLICY

Store uses cookies.

Cookies are text files that are stored on customer’s device, used by the server to recognize the user's device and data. Cookies are used at every entrance to Store website and exit from the site. Cookies are not used to determine identity of customer.

Cookies are used to adjust the content of website to customer’s preferences and optimizing the use of website. They are also used to create anonymous, aggregated statistics that help to understand how the customers use the website, which allows Store to improve the structure and content , except for personal identification.

Standard software by default allows placement of cookies on device. These settings can be modified in such a way as to block the automatic handling of cookies in the settings of your web browser or inform on them each time you submit on device. Detailed information about the possibilities and ways of handling cookies are available in the software settings. Restricting the use of cookies may affect some of the functionality available on the Store website.

9. FINAL PROVISIONS

The competent court for any disputes arising from the contract of sale concluded via Store is the court competent for the defendant. The laws of Poland are applicable to contracts concluded by Store.

In all matters not regulated by the Terms & Conditions the provisions of the Act of 30 May 2014 on Consumer Rights shall apply. The provisions of the Terms & Conditions shall not affect the rights of the consumer provided by the general applicable laws of Poland. The provisions of the Terms & Conditions should be interpreted in a way that ensures their compliance with all applicable laws.

Store reserves the right to unilaterally amend Terms & Conditions at any time and without having to justify the cause.

In case of any changes to Terms & Conditions, Store shall immediately inform customers by publication of the consolidated text of Terms & Conditions on the http://www.nukishop.co In the event of changes of Terms & Conditions after the placement of order, customer is entitled to cancel the order. The changes do not apply to orders already shipped to customer.

Terms & Conditions come into force from the date of publication on the Store’s website.

In case of change or cancellation of the provisions of Terms & Conditions as a result of a final court judgments, the remaining provisions shall remain in force and binding.
